Definitions

In these terms and conditions of business, the following meanings shall apply:-

Acceptance of our conditions

Please read our terms and conditions set out in this document and agree to them before placing an order.

If you are under the age of 18, you may use the web site only with the permission or involvement of a parent or guardian.

When you register you may choose a customer username and password and you are responsible for all activities which occur under your customer username and password, save where such activities occur as a result of our negligence or fault.

Price and Payment

The price payable for the goods you order is as set out on our web site at the time you place the order, plus delivery charges.

Whilst every endeavour is made to ensure prices are correct, we reserve the right to vary prices at any time and to change the price of commodity goods and not to supply goods which are found to be incorrectly priced .You may re-confirm the order upon price amendment, or cancel the order and receive a full refund at the discretion of electricalwarehouse.com.

Prices are exclusive of value added tax or duties which the buyer shall be additionally liable to pay to the company.

On occasion, prices payable of goods advertised on our web site may differ from those offered in the current catalogue or one of our trade counters. We are under no obligation to honor alternative prices if there is a difference and the web advertised price will prevail on all web orders.

We must receive payment for the whole of the price of the goods you order, and any applicable charges for delivery, before your order can be processed unless we have agreed otherwise in advance by writing.

Should you wish to take advantage of a “price match” offer, you are required to contact us in advance of placing an order, providing details of the product you wish to price match, the URL/Website address, where you have found the product(s) at a lower price and the price you want us to match. This offer only applies to items we are advertising for sale at the time you wish to buy them. The item you wish us to price match must be identical, new and in stock. We reserve the right to refuse to price match an item offered for sale lower than our own buying price.

Transactional Safety

Delivery

Delivery dates and times specified by the company are approximate only; time is not and shall not be deemed to be of the essence of the contract. The customer shall make all arrangements necessary to take delivery of goods with a valid signature on delivery and whenever they are tendered for delivery.

The customer must not schedule or commence any installation work until after receiving the order and all the goods have been checked for defects or missing parts.

We shall not be liable for any loss arising from items being out of stock, or arising from problems with delivery including late, incomplete or damaged items. Claims for late or damaged items must be made via e mail to online@contemp.com within 3 days of delivery.

For health and safety and to avoid any property damage, heavy items can only be delivered to a ground floor location at the given delivery address. You must therefore make your own arrangements at your own risk should items require moving to an upper floor.

Cancellation and Returns

Orders may be cancelled up to 7 days after delivery. Should you wish to cancel an order, we will refund you on return of the goods. The return of goods will be at the customers cost and must be made using a ‘signed for’ carrier service.

We cannot accept the return of goods which are damaged or incorrect or if they have been used or removed from their original packaging.

Upon satisfactory inspection the sale will be credited less the initial carriage charge which will be advised to the customer upon receipt of an order cancellation request.

We reserve the right to exclude from our cancellation & returns policy, any ‘special goods’ made or altered to the customer’s specification (for example, cable cut to length).

Any refunds of goods surplus to requirements after the 7 day period are entirely at the discretion of electricalwarehouse.com.

Damaged Goods and Shortages

The quantity of any consignment of goods as recorded by us upon dispatch from our place of business shall be evidence of the quantity received by you on delivery, unless you can provide conclusive evidence to the contrary.

We will not accept any liability for short delivery, loss or damage to goods occurring prior to delivery or for non-delivery (even if caused by our negligence) unless claims to that effect are notified to us and our designated carriers within 24 hours of delivery (in the case of damage or short delivery) or within 24 hours of our invoice or advice note (in the case of non-delivery). Goods received in a damaged or unsatisfactory condition must be signed for as such and the packaging and content must be retained for inspection as failure to do so will invalidate any claim.

Our total liability for short delivery, loss or damage to the goods prior to delivery, or non-delivery of the goods, shall be limited to (in each case at our discretion) repairing or replacing free of charge goods within a reasonable time, or a refund of the price at the pro rata contract rate.

Short or Non-Delivery

If you experience a short or non delivery, please contact our customer service department with the following information at online@contemp.com

a) Customer Order number
b) The date of purchase
c) The product code (s)

Our customer service department will investigate the problem and refer back to you as soon as possible.

Liability

The customer must notify us of any problems with good(s) within 30 days of delivery, whereby we will either make good any shortages or non-delivery; replace or repair any goods that are damaged or defective upon delivery; or refund the amount paid at the time of order.

We shall have no liability to pay any money to you by way of compensation other than any refund we make under these conditions.

Our liability to you shall not in any event include losses related to any business of yours, such as loss of profits or business interruption; neither will we be responsible to you for any other loss which is not a foreseeable consequence of us being in breach of these terms and conditions or our legal duties.

This does not affect your statutory rights if you are a consumer, nor is it intended to exclude our liability to you for fraudulent misrepresentation or for death or personal injury resulting from our negligence.

Goods are intended for use in the UK only and we cannot confirm that the goods comply with any laws, regulations or other standards applicable outside the UK. All goods are sold in accordance with the manufacturer’s specifications and are subject to any qualifications, representations or instructions contained in the documentation associated with the goods.

Force Majeure

We shall not be liable for any default to any act of God, war, short fall of manufacturer, strike, lock outs or industrial action

Goods are intended for use in the UK and we make no warranties that the goods are suitable for use outside the UK, or comply with any laws.
